BALIK STICKS PROGRAM

Terms & Conditions

I. General

a. The Balik Sticks Program (“Program”) is open to legal age smokers and users of other nicotine-containing products who are at least 18 years old (as of the date of his/her participation in the Offer) and above residing in the Philippines (“Customer”), and who would otherwise wish to continue to use tobacco or nicotine containing products.

b. The Program can be availed at identified retailers who have been selected by PMFTC to be the “Participating Retailers” for this offer. The said Participating Retailers are duly accredited retail (business-to-business) customers of the PMFTC Direct Selling & Distribution Team and are enrolled in the Appwards Digital Trade Engagement (DTE) platform.

c. The Program period will run from December 1, 2023 to January 8, 2024. PMFTC has the discretion to shorten or extend the program period if circumstances so warrant.

d. PMFTC/AAI reserves the right to modify, change, or revise the rules and mechanics of the Program.

e. PMFTC/AAI reserves the right to disqualify any Participating POS if there is any evidence of fraud, irregularities in his/her participation in the Program, or violations to the Program terms and conditions.

f. PMFTC/AAI reserves the right to cancel, amend, or revoke these terms and conditions without notice in the event of fraudulent activity, cheating, a security breach or any anticipated breach of any applicable law or regulation, an event or disturbance outside of PMFTC’s control such as acts of God, civil or military events, catastrophes, technical issues/connectivity, pandemic or war. Any changes to the Offer will be announced accordingly.

h. Participating Retailer must not advertise or promote PMFTC products or brands on personal or private social media accounts.

i. By participating in the Program, Participating Retailer confirms his/her consent to collect and process his/her personal data provided as part of the Program. Only the authorized representative of PMFTC is allowed to secure the Customer information during the processing of the Customer transaction. The Participating Retailer is not authorized to secure and use any Customer personal information. PMFTC will retain your information for the period necessary to fulfill the purposes for which the information was collected and will be processed in accordance with Philip Morris International’s (PMI) Trader Privacy Notice found at https://www.pmiprivacy.com/global/en/traders. You are entitled to certain rights in relation to the personal data that are collected from you, including the right to access, correct, and object to the processing, as well as the right to lodge a complaint before the National Privacy Commission in case of violation of your rights as data subject.

 

II. Mechanics

a. The Customer who successfully qualifies for a program reward at the Participating Retailer’s store, subject to the Terms & Conditions of the Balik Sticks Program, is eligible to receive free HEETS/BLENDS sticks. The Customer shall receive either of the following:

b. The free sticks are only redeemable from Participating Retailers, only applicable to HEETS/BLENDS sticks (Customer’s variant of choice), and are not convertible to cash, discounts, and/or other goods from the Participating Retailer. The Participating Retailer should provide the corresponding reward in exchange for the filled pouch of 10 HEETS/BLENDS sticks. No 10 HEETS/BLENDS sticks returned, no reward.

c. In return, the Participating Retailer returns all collected filled pouches of 10 HEETS/BLENDS sticks to the designated field executive (FE) and gets rewarded with an IQOS Voucher worth 25 Appwards points for every filled pouch returned. The Participating Retailer must immediately input the voucher code in Appwards to secure redemption of Appwards points.

d. It is the Participating Retailer’s responsibility to collect the filled pouch of 10 HEETS/BLENDS sticks from the Customer before issuing any reward.

e. The Participating Retailer shall provide the Customer with their HEETS/BLENDS variant of choice, subject to availability, during reward redemption from their current HEETS/BLENDS selling stock.

f. In cases where certain variants are not available within the stock-on-hand of the Participating Retailer, the Participating Retailer is free to replace the out-of-stock variant depending on the choice of the Customer.

g. The IQOS Voucher and corresponding Appwards points can only be redeemed in full in a single transaction and is not transferrable. Any amount not used or redeemed cannot be exchanged for cash or another IQOS voucher and will be automatically forfeited.

h. PMFTC/AAI shall not be liable for any failure of a Participating Retailer to use or redeem any IQOS Voucher, and will not refund such voucher due to among others, loss, negligence or mishandling on the part of the Participating Retailer.

i. PMFTC reserves the right to change the valuation of the IQOS Vouchers if circumstances warrant.

j. Redemption of Appwards points from IQOS Vouchers are subject to possible delays due to operational, technical and system limitations. Participating Retailers will be advised beforehand if such is the case.

k. For failed redemptions of Appwards points from IQOS Vouchers, Participating Retailer may request for a one-time replacement IQOS Voucher from Appwards Customer Care (#PM888), subject to the following:

i. Validation of IQOS Voucher

ii. Review of the failed redemption of Appwards points (e.g. voucher non-receipt, system issues, etc.)

iii. Participating Retailer’s eligibility and compliance with the requirements stated

iv. Upon investigation and remediation, Participating Retailer would be asked to repeat the redemption of the IQOS Voucher in Appwards. A replacement IQOS Voucher is provided if a failed redemption persists. PMFTC/AAI is not liable for cases wherein the IQOS Voucher is already redeemed by another retailer and shall not provide a replacement for such.

l. PMFTC reserves the right to change the valuation of the IQOS voucher if circumstances awrrant.

 

III. Others

a. All decisions of PMFTC/AAI and/or its authorized representatives in all matters relating to the interpretation and implementation of this mechanics are final, and no objections and/or appeals thereon will be entertained.

b. Customers in the Program agree and confirm the following:

i. that he/she is a legal-age smoker at least 18 years old or above as of the date of his/her participation in the Offer;

ii. that he/she has read and understood the terms and conditions detailed herein;

iii. that he/she agrees to follow the applicable mechanics of the Program;

iv. that he/she agrees to assume all such risks, foreseeable or otherwise, and hereby release and discharge PMFTC and/or AAI, its affiliates and all other persons and entities connected with the Program from any liability for, or any claims that may arise in respect of, any and all property losses and/or injuries whatsoever that he/she may sustain, no matter how any such property losses and/or injuries are caused.

d. PMFTC will not be liable to the Customer for any taxes, costs, liabilities or expenses that may arise from this Offer.
