ILUMA LEGACY DEVICE LINKING OFFER

Terms & Conditions

I. GENERAL

1. The ILUMA LEGACY DEVICE LINKING offer with details provided in Sections II and III below (“Offer”) is open to legal age users who are at least 18 years old (as of the date of his/her participation in the Offer) and above residing in the Philippines (“Customer”) who otherwise wish to continue to use tobacco or nicotine containing products. To qualify and be eligible for the Offer, the Customer should create an IQOS account and register to IQOS Club.

2. The Offer can be availed in selected IQOS Official Stores (physical). IQOS Stores are operated by ActivAsia Inc. (or "AAI"). IQOS.com is owned by Philip Morris International and its affiliate in the Philippines, PMFTC Inc ("PMFTC"). This Offer is being carried out by AAI as an authorized distributor of PMFTC products.

3. Offer period if from Oct 3, 2023 – Oct 31, 2023 or until supplies last. PMFTC/AAI has the sole discretion to shorten or extend the Offer period if circumstances so warrant.

4. PMFTC/AAI reserves the right to modify, change, or revise the rules and mechanics of the Offer.

5. Customers using multiple IQOS.com accounts to participate in the Offer are disqualified. PMFTC/AAI reserves the right to disqualify any Customer if there is any evidence of fraud or irregularities in his/her participation in the Offer.

6. PMFTC/AAI reserves the right to hold, suspend or block a Customer’s IQOS.com account due to suspicious, fraudulent or illegal activity.

7. PMFTC/AAI reserves the right to cancel, amend, or revoke these terms and conditions without notice in the event of fraudulent activity, cheating, a security breach or any anticipated breach of any applicable law or regulation, an event or disturbance outside of PMFTC’s control such as acts of God, civil or military events, catastrophes, technical issues/connectivity, pandemic or war. Any changes to the Offer will be announced accordingly.

9. By participating in the Offer, Customer confirms his/her consent to process his/her personal data provided as part of the Offer. Details of such processing are described in Philip Morris International’s (PMI) Consumer Privacy Notice found at https://www.pmiprivacy.com/en/consumer and AAI’s Data Privacy Consent Policy.

II. MECHANICS

1. For Customers to be eligible to the Offer:

i. Customer should have an original*, functioning**, unlinked IQOS ILUMA device. “Unlinked” means the IQOS ILUMA device is not yet linked to the IQOS account of the Customer.

IQOS ILUMA device should be within the warranty period.

*IQOS ILUMA device is subject to the standard IQOS device assessment of the IQOS Sales Expert.

** An IQOS ILUMA device is functioning if:

If the IQOS ILUMA Device does not meet the criteria of a functioning device, it is deemed a non-functioning device.

ii. Customer should create / have an IQOS account.

iii. Customer should register to IQOS Club.

2. The Offer is a one-time offer wherein the eligible Customer (based on the conditions provided in Section II.1 above) is required to link their IQOS ILUMA device to their IQOS account.

3. Upon completion of the linking of the IQOS ILUMA device to the Customer’s IQOS account, the Customer will receive:

i. A FREE one (1) IQOS ILUMA Ring Set will be given to the Customer.

ii. 300 points in their IQOS CLUB account - IQOS ILUMA device linking points will be credited in the IQOS Club account within 5 – 10 business days from the date of the IQOS LUMA device linking.

4. If a Customer owns multiple IQOS ILUMA devices, Customer can only link up to two (2) IQOS ILUMA devices to his/her IQOS account.

5. The participating Customer will be subject to age verification process wherein he/she will be requested to submit a valid Government Issued ID before items can be purchased and/or delivered to the Customer. The following valid Government Issued IDs as proof of age: Passport, Alien Certificate of Registration, Driver's License, Firearms License, NBI Clearance Card, Philhealth ID, Postal ID, PRC ID, SSS ID, TIN ID, Unified Multi-Purpose ID or Voter's ID.

III. OTHERS

1. All decisions of PMFTC and/or AAI and its agents in all matters relating to the interpretation and implementation of this mechanics/terms and conditions are final, and no objections and/or appeals thereon will be entertained.

2. Customers in the Offer agree and confirm the following:

that you are a legal-age smoker at least 18 years old or above as of the date of his/her participation in the Offer;
that you have read and understood the terms and conditions detailed herein;
that you agree to follow the applicable mechanics of the Offer;
that you agree to assume all such risks, foreseeable or otherwise, and hereby release and discharge PMFTC and/or AAI, its affiliates and all other persons and entities connected with the Offer from any liability for, or any claims that may arise in respect of, any and all property losses and/or injuries whatsoever that you may sustain, no matter how any such property losses and/or injuries are caused.

4. PMFTC will not be liable to the Customer for any taxes, costs, liabilities or expenses that may arise from this Offer.
