Terms and Conditions

 

1. Introduction to IQOS.com Subscription

1.1 Welcome to the IQOS.com Subscription program which provides you with regular delivery of Zyn Nicotine Pouches, TEREA or LEVIA heat sticks, or VEEV Pods (the Consumables) to your nominated UK delivery address.

1.2 These terms and conditions (Terms) are between you and Philip Morris Limited, a member of the Philip Morris International group of companies with offices at 10 Hammersmith Grove, W6 7AP, London, UK (PML or “we”) and govern Subscription. Please read these Terms carefully before using Subscription.

1.3 We may amend these Terms from time to time. Unless we expressly state otherwise, all amendments will be immediately effective on the posting of such updated Terms on our websites iqos.com, or zyn.com. If we make significant changes to these Terms, you will be notified through email. If you do not agree to the changed Terms, then you may cancel your Subscription. Your continued use of Subscription constitutes your consent to be bound by these Terms, as amended from time to time.

2. Eligibility

2.1 You are only eligible for Subscription if: (i) you are an adult (18+) registered user of Zyn, IQOS or VEEV; and (ii) your delivery address and your home address (if different) are both in the United Kingdom.

2.2 Only individuals may benefit from Subscription. Companies, partnerships, unincorporated associations and other legal entities are not eligible. 

2.3 Your participation in Subscription is at our discretion and we reserve the right to refuse your participation in Subscription.

2.4 You can only have one Subscription active at any one time, but that Subscription may include different types of products, as available in your country – for example, TEREA/LEVIA /VEEV pods/ZYN.

2.5 Under the Subscription TEREA and LEVIA, may only be ordered by bundle (one bundle of TEREA or LEVIA contains 10 packs, each of which contain 20 sticks), VEEV may only be ordered by pack (one pack of VEEV contains 2 pods, each of which contain 2 pods) and ZYN may be only ordered by can (one can of ZYN contains 20 nicotine pouches).

3. Start of Subscription / Subscription Payments

3.1 These Terms will be effective on the date you place your first order. Once you have submitted your initial Subscription order, which must be a minimum of 1 bundle of TEREA or LEVIA, or 1 pack of VEEV pods or 1 can of ZYN nicotine pouches or combination of these per month. There are maximum order volumes that apply per product too. For TEREA or LEVIA there is a maximum of 5 bundles per order; for VEEV there is a maximum of 20 packs per order; and for ZYN there is a maximum of 20 cans per order.

3.2 Payment can be made with Visa, Mastercard, or direct debit. Payment will be taken on the order date ahead of dispatch, and one-day prior to delivery.

3.3 We will send you an order confirmation of your Subscription which will include the monthly payments for each order, the first of which will be based on your Standard Order.

3.4 Payment will be taken on or around the date when Philip Morris processes each Subscription order for delivery (Cut-Off Date). 

3.5 If all eligible payment methods we have on file for you are declined for payment of your Subscription, you must provide us with a new eligible payment method promptly or your Subscription will be paused until such time as you provide us with a new eligible payment method.

4. Customizing your Subscription

4.1 You may customize your Standard Order to increase it up to the maximum quantities established in section 2.5 of this Terms. You may also decrease your Standard Order subject to Section 2.5 which sets out the minimum Subscription order.

4.2 You may customise your Standard Order to change the flavour(s) or product(s) selected to any of the flavours or products available in the UK.

4.3  You may customise your Standard Order to change your delivery address provided that your new delivery address is also in the UK.

4.4 You may change the delivery frequency for your Standard Order. You can set the frequency for your Standard Order to: every 2 weeks (bi-weekly); every 4 weeks (monthly); or every 8 weeks (bi-monthly).

4.5 Each customisation request will automatically update your Standard Order to reflect the changes you have requested for all future Auto Deliveries.

4.6 If any of these changes are requested after your Cut-Off date displayed on your Subscription account dashboard, these changes will only be applicable for your next order.

5. Changing your Subscription Date

5.1 You may make changes in your delivery date at any time up to the Cut-Off Date by bringing the date forward by up to one week or delaying it by up to one week. Any subsequent Auto Deliveries will be adjusted and delivered according to this new schedule for your Standard Order.

5.2 You may change your future delivery dates by selecting a new date range each month on your Subscription account dashboard. If you change the delivery date after the Cut-Off Date for your next Subscription, your change will take effect for your next delivery.

6. Skipping your Subscription

6.1 At any time ahead of the cut-off date, you may skip your next Subscription order. Simply log-in to your account, navigate to ‘My Subscriptions’ and select to ‘Skip next delivery’. We allow for 3 consecutive ‘skips’ in a row before your subscription is automatically cancelled.

6.2 If your skip request is made after the Cut-Off Date for your next Subscription, your change will take effect on the following scheduled delivery.

6.3 We will partly-deliver your Subscription if the flavours specified in your Standard Order are out of stock on the date we process your order. We will contact you to ask if you wish to order other in stock flavours. If not, you will receive your Subscription the following month according to your Standard Order date.

6.4 Without prejudice to Section 10, we will cancel your Subscription in the event we are unable to access your delivery address or if we are informed you are no longer at the delivery address. We will contact you to request that you update your address.

6.5 Without prejudice to Section 10, if your payment is not made due to your credit card having expired or if we are having any problems processing your payment then we will re-attempt payment collection once a day for three consecutive days. We will contact you to ask you to update your payment method. However, if the third payment attempt is unsuccessful then we will cancel your subscription order.

7.  Subscription Pricing Commitment  

7.1 Subscription customers on IQOS.com will benefit from our best available ‘always-on’ pricing. For TEREA and LEVIA consumers, the available discount will vary dependent on whether you are a member of our IQOS CLUB or not. IQOS CLUB members will have their tier-linked member-only pricing carried over to all their subscription orders. Throughout the year, we may run limited-time promotions on the website that could provide lower pricing on certain consumables (TEREA/LEVIA/VEEV/ZYN).

7.2 Any updates or revisions you make to quantities, types of products, and possibly even flavours in your Subscription order may change the price of your IQOS Subscription.

8.  Your Obligations

8.1 You agree:

(a)  to keep your Subscription account, including its password, safe and secure;

(b)  that you are responsible for all purchases made on your Subscription account;

(c)  that you are responsible for all actions and changes to your Subscription account in the logged in pages on your Subscription dashboard;

(d)  that you will notify us immediately if you suspect or know that anyone has gained unauthorized access to your Subscription account

(e)  to promptly inform us when you change your address and/or payment details and provide to us your new address details and/or new payment details;

(f)   to comply with applicable law; and

(g)   to comply with these Terms.

9. IQOS Club

If you decide to suspend or terminate Subscription, your membership in the IQOS Club will not be affected.

10. Termination of Subscription

10.1 An Subscription programme may be terminated by you or Philip Morris in accordance with this Section 10.

10.2 You may terminate your Subscription at any time by logging in to your Subscription account and clicking on the “Cancel” button or by calling our Customer Care team [Markets to adjust/add channels in which Subscription management is enabled]. If you terminate after the Cut-Off Date for your next Subscription, your termination will take effect after that delivery.

10.3 Philip Morris will terminate your Subscription at any time with immediate effect if you breach these Terms.

10.4 If there is an Subscription already in the process of being delivered when Philip Morris receives your notice of termination your termination will take effect after that monthly Subscription has been made.

10.5 Upon termination of your Subscription, no further monthly Auto Deliveries will be made, and no further monthly payments are payable. 

11. Data Privacy

Philip Morris will receive, store, and otherwise process your personal information in connection with your Subscription and administering it. 12. Warranty/Representation/Limitation of Liability

12.1 Philip Morris shall not be liable whether in tort (including for negligence or breach of statutory duty), contract, misrepresentation, restitution or otherwise for any direct losses, loss of profits, sales, revenues or savings, loss of business, depletion of goodwill and/or similar losses or loss or corruption of data or information, or pure economic loss, or for any special, indirect or consequential loss, costs, damages, charges or expenses however arising or otherwise resulting from your Subscription. Philip Morris shall not be liable for any of the losses described in this Section even if you have informed Philip Morris of the possibility of such losses. This limitation of liability will apply to the fullest extent permitted by applicable law and will survive cancellation or termination of your Subscriptions.

12.2 Nothing in this Section excludes any liability that cannot be excluded by applicable law.

13. Miscellaneous

13.1 Philip Morris’s failure to enforce these Terms shall not constitute a waiver of these Terms, or any of its provisions, including our right to terminate your Subscription.

13.2 Philip Morris is not responsible for any incorrect or inaccurate information supplied by you during your Subscription, nor for any lost or misdirected communications to or from you regarding your Subscription.

13.3 If any flavour of the products is discontinued, Philip Morris will inform you and you can decide if you replace the product flavour or if you change or cancel your Standard Order.

13.4 Notices by Philip Morris hereunder may be made in writing including by email or through an announcement on our website.

13.5 These Terms are subject to the laws of the United Kingdom. Any legal dispute will be subject to the exclusive jurisdiction to the courts of the United Kingdom.

13.6 Any provision of these Terms declared void or unenforceable by any competent authority or court shall, to the extent of such invalidity or unenforceability, be deemed severable and shall not affect the other provisions remaining which shall continue unaffected.
