EXPERIENCE PARTICIPATION TERMS AND CONDITIONS – CARGO CARTING

These Experience Participation Terms and Conditions (the "Terms") are entered into between Philip Morris Limited (together with its affiliated companies, "PM") and the individual accepting these Terms (the "Participant", "you", or "your").

These Terms govern the basis on which you may participate in the following Electric Dreams experience in 2026 (the “Participation”): Cargo Carting (Portugal, 23–26 September 2026).

By accepting these Terms and participating in the Experience, you confirm that you have read, understood, and agree to be legally bound by them.

1. Eligibility, Attendance and Registration

1.1 You warrant and represent that you are 18 years of age or older and that you are an IQOS user. If you do not satisfy these eligibility criteria, you must not accept or participate in the Experience.

1.2 Participation in the Experience is conditional upon (i) your acceptance of these Terms and (ii) confirmation of attendance by the deadline specified in the invitation or related communications.

1.4 For the purposes of the Experience attendance and registration, you agree to provide your mobile telephone number to PM and/or any third party engaged by PM in connection with the organisation or administration of the Experience (the "Contractors").

1.5 You acknowledge that you may be required to complete a registration process and provide certain personal data prior to attending the Experience.

2. Publicity Release

2.1 To the fullest extent permitted by applicable law, you irrevocably grant to PM and any entity that controls, is controlled by, or is under common control with PM (the "Affiliates") the unrestricted right to:

(a) use your name, image, likeness, voice, and biographical information in connection with communications, promotional, and publicity materials relating to the Experience; and

(b) record, film, photograph, and otherwise capture your Participation in the Experience by any means (audio, audiovisual, or otherwise).

The materials referred to in paragraphs (a) and (b) above are collectively referred to as the "Material".

2.2 PM and its Affiliates shall have the exclusive, perpetual, worldwide, irrevocable, and royalty-free right to use, reproduce, adapt, edit, publish, distribute, and otherwise exploit the Material in any media now known or developed in the future (including digital and social media), without any obligation to pay you any fee or compensation. The Material shall remain the sole and exclusive property of PM and/or its Affiliates at all times.

2.3 PM may edit, alter, or adapt the Material as it reasonably considers appropriate, provided that such use is not derogatory and relates solely to the Experience.

2.4 You agree not to use any Material or items provided to you in connection with the Experience except for private, non-commercial purposes and solely for the purpose for which they were provided.

2.5 Where you share any content created by you in connection with the Experience for private, non-commercial purposes (including images, videos, or text) ("User Generated Content" or "UGC"), you grant PM the right to use such UGC in accordance with the License to Use User Generated Content available at: https://www.iqos.com/gb/en/iqos-community-terms.html

2.6 To the fullest extent permitted by law, you irrevocably and unconditionally waive all moral rights (or equivalent rights in any jurisdiction) in respect of the Material.

3. Data Protection and Privacy

3.1 Subject to applicable data protection laws, PM, its Affiliates and its suppliers may collect, store, use and otherwise process personal data relating to you for purposes connected with the organisation, administration and delivery of the Experience. Such data may include, your contact details, date of birth, identification documents required for verification or travel (such as passport or national ID information), gender (where required for bookings), travel‑related documentation (such as visa information, flight or accommodation details), Experience‑related records (meaning information necessary to arrange, manage or document the Experience, including attendance information, booking confirmations and activity selections), and the  Material..
 Where required under applicable data protection laws, the legal basis for the processing of this personal data is that such processing is necessary for the performance of a contract to which you are a party, or in order to take steps at your request prior to entering into such a contract.

3.2 Your personal data may be shared with and processed by Contractors and other third parties involved in the Experience, with whom PM has a contract, including parties located in jurisdictions that may not provide the same level of data protection as your country of residence. In such cases, PM will implement appropriate safeguards and technical and organisational measures in accordance with applicable law.

3.3 The PMI Consumer Privacy Notice (available at https://www.pmiprivacy.com/global/en/consumer/) applies to this processing, as supplemented by this section.

4. Release of Liability

4.1 To the fullest extent permitted by applicable law, you hereby waive, release, and forever discharge PM, its Affiliates, partners, Contractors, and their respective officers, employees, and agents (together, the "Released Parties") from any and all claims, demands, losses, damages, liabilities, costs, or expenses (including legal fees), whether arising in contract, tort (including negligence), or otherwise, arising out of or in connection with your Participation in the Experience.

4.2 This release applies irrespective of cause, including where such claims arise from the negligence or fault of any of the Released Parties, and includes the provision of emergency, medical, or other assistance at the Experience.

4.3 PM shall not be liable for the cancellation, postponement, modification, or change in format of the Experience, nor for the conduct or actions of other participants or guests.

5. Assumption of Risk

5.1 Participation in the Experience is voluntary and undertaken entirely at your own risk. You acknowledge and accept all risks, whether foreseeable or not, including risks of personal injury, illness, death, or loss of or damage to personal property.

5.2 You confirm that you are in good health and that you are not aware of any medical condition that would prevent or adversely affect your safe participation in the Experience.

6. Indemnity

You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising directly or indirectly from your acts or omissions in connection with the Experience or any breach of these Terms.

7. Itinerary and Group Participation

You agree to comply with the official itinerary, schedules, and hosted activities as communicated by PM. Any deviation from the official programme is excluded unless expressly approved in advance by PM in writing.

8. Expenses

8.1 PM shall cover only those expenses expressly communicated in advance as being included, which may include transportation, accommodation, meals, and scheduled activities.

8.2 All personal or incidental expenses are excluded, including, without limitation, minibar charges, room service, additional food or beverages, telephone calls, laundry, spa treatments, upgrades, additional nights, or activities outside the official programme.

9. Travel Documentation and Eligibility

You are solely responsible for ensuring that you hold a valid passport for at least 6 months, visa, vaccinations, and other travel documentation required for participation in the Experience. Failure to meet applicable entry or travel requirements may result in exclusion from the Experience without compensation.

10. Conduct, Health and Safety

10.1 You agree to comply with all applicable laws, venue rules, safety instructions, and reasonable directions issued by PM, venue staff, or Contractors.

10.2 PM reserves the right to exclude or remove you from the Experience, without compensation, where conduct is disruptive, unsafe, unlawful, or otherwise inappropriate.

10.3 Where alcohol is served, you agree to consume alcohol responsibly and in accordance with applicable laws and venue policies.

11. Programme Changes

PM reserves the right to amend or modify the itinerary, timings, venues, or activities of the Experience due to operational, safety, weather-related, or other circumstances beyond its reasonable control.

12. Non-Transferability

Your participation in the Experience is personal, non-transferable, non-exchangeable, and may not be redeemed for cash or alternative benefits.

13. Early Departure or Non-Attendance

No refund, compensation, or alternative arrangement shall be provided if you arrive late, depart early, or fail to participate fully in the Experience for any reason.

14. Medication and Drugs

14.1 You are responsible for complying with all applicable laws relating to prescription medication and for carrying relevant prescriptions or supporting documentation when travelling.

14.2 The use, possession, or promotion of illegal drugs or controlled substances in connection with the Experience is strictly prohibited and may result in immediate exclusion.

15. Governing Law and Jurisdiction

These terms and conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, or their subject matter or formation shall be governed by and construed in accordance with the laws of England.

Each party irrevocably agrees that the courts of England and Wales] shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these terms and conditions, their subject matter, or formation.

By accepting these Terms and participating in the Experience, you confirm that you have read, understood, and agree to be legally bound by them.

1.1 You warrant and represent that you are 18 years of age or older and that you are an IQOS user. If you do not satisfy these eligibility criteria, you must not accept or participate in the Experience.

By accepting these Terms and participating in the Experience, you confirm that you have read, understood, and agree to be legally bound by them.

By accepting these Terms and participating in the Experience, you confirm that you have read, understood, and agree to be legally bound by them.

(b) record, film, photograph, and otherwise capture your Participation in the Experience by any means (audio, audiovisual, or otherwise).

The materials referred to in paragraphs (a) and (b) above are collectively referred to as the "Material".

2.2 PM and its Affiliates shall have the exclusive, perpetual, worldwide, irrevocable, and royalty-free right to use, reproduce, adapt, edit, publish, distribute, and otherwise exploit the Material in any media now known or developed in the future (including digital and social media), without any obligation to pay you any fee or compensation. The Material shall remain the sole and exclusive property of PM and/or its Affiliates at all times.

2.3 PM may edit, alter, or adapt the Material as it reasonably considers appropriate, provided that such use is not derogatory and relates solely to the Experience.

2.4 You agree not to use any Material or items provided to you in connection with the Experience except for private, non-commercial purposes and solely for the purpose for which they were provided.

2.5 Where you share any content created by you in connection with the Experience for private, non-commercial purposes (including images, videos, or text) ("User Generated Content" or "UGC"), you grant PM the right to use such UGC in accordance with the License to Use User Generated Content available at: https://www.iqos.com/gb/en/iqos-community-terms.html

2.6 To the fullest extent permitted by law, you irrevocably and unconditionally waive all moral rights (or equivalent rights in any jurisdiction) in respect of the Material.

3. Data Protection and Privacy

3.1 Subject to applicable data protection laws, PM, its Affiliates and its suppliers may collect, store, use and otherwise process personal data relating to you for purposes connected with the organisation, administration and delivery of the Experience. Such data may include, your contact details, date of birth, identification documents required for verification or travel (such as passport or national ID information), gender (where required for bookings), travel‑related documentation (such as visa information, flight or accommodation details), Experience‑related records (meaning information necessary to arrange, manage or document the Experience, including attendance information, booking confirmations and activity selections), and the Material.. Where required under applicable data protection laws, the legal basis for the processing of this personal data is that such processing is necessary for the performance of a contract to which you are a party, or in order to take steps at your request prior to entering into such a contract.

3.2 Your personal data may be shared with and processed by Contractors and other third parties involved in the Experience, with whom PM has a contract, including parties located in jurisdictions that may not provide the same level of data protection as your country of residence. In such cases, PM will implement appropriate safeguards and technical and organisational measures in accordance with applicable law.

3.3 The PMI Consumer Privacy Notice (available at https://www.pmiprivacy.com/global/en/consumer/) applies to this processing, as supplemented by this section.

4. Release of Liability

4.1 To the fullest extent permitted by applicable law, you hereby waive, release, and forever discharge PM, its Affiliates, partners, Contractors, and their respective officers, employees, and agents (together, the "Released Parties") from any and all claims, demands, losses, damages, liabilities, costs, or expenses (including legal fees), whether arising in contract, tort (including negligence), or otherwise, arising out of or in connection with your Participation in the Experience.

4.2 This release applies irrespective of cause, including where such claims arise from the negligence or fault of any of the Released Parties, and includes the provision of emergency, medical, or other assistance at the Experience.

4.3 PM shall not be liable for the cancellation, postponement, modification, or change in format of the Experience, nor for the conduct or actions of other participants or guests.

5. Assumption of Risk

5.1 Participation in the Experience is voluntary and undertaken entirely at your own risk. You acknowledge and accept all risks, whether foreseeable or not, including risks of personal injury, illness, death, or loss of or damage to personal property.

5.2 You confirm that you are in good health and that you are not aware of any medical condition that would prevent or adversely affect your safe participation in the Experience.

6. Indemnity

You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising directly or indirectly from your acts or omissions in connection with the Experience or any breach of these Terms.

7. Itinerary and Group Participation

You agree to comply with the official itinerary, schedules, and hosted activities as communicated by PM. Any deviation from the official programme is excluded unless expressly approved in advance by PM in writing.

8. Expenses

8.1 PM shall cover only those expenses expressly communicated in advance as being included, which may include transportation, accommodation, meals, and scheduled activities.

8.2 All personal or incidental expenses are excluded, including, without limitation, minibar charges, room service, additional food or beverages, telephone calls, laundry, spa treatments, upgrades, additional nights, or activities outside the official programme.

9. Travel Documentation and Eligibility

You are solely responsible for ensuring that you hold a valid passport for at least 6 months, visa, vaccinations, and other travel documentation required for participation in the Experience. Failure to meet applicable entry or travel requirements may result in exclusion from the Experience without compensation.

10. Conduct, Health and Safety

10.1 You agree to comply with all applicable laws, venue rules, safety instructions, and reasonable directions issued by PM, venue staff, or Contractors.

10.2 PM reserves the right to exclude or remove you from the Experience, without compensation, where conduct is disruptive, unsafe, unlawful, or otherwise inappropriate.

10.3 Where alcohol is served, you agree to consume alcohol responsibly and in accordance with applicable laws and venue policies.

11. Programme Changes

PM reserves the right to amend or modify the itinerary, timings, venues, or activities of the Experience due to operational, safety, weather-related, or other circumstances beyond its reasonable control.

12. Non-Transferability

Your participation in the Experience is personal, non-transferable, non-exchangeable, and may not be redeemed for cash or alternative benefits.

13. Early Departure or Non-Attendance

No refund, compensation, or alternative arrangement shall be provided if you arrive late, depart early, or fail to participate fully in the Experience for any reason.

14. Medication and Drugs

14.1 You are responsible for complying with all applicable laws relating to prescription medication and for carrying relevant prescriptions or supporting documentation when travelling.

14.2 The use, possession, or promotion of illegal drugs or controlled substances in connection with the Experience is strictly prohibited and may result in immediate exclusion.

15. Governing Law and Jurisdiction

These terms and conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, or their subject matter or formation shall be governed by and construed in accordance with the laws of England.

Each party irrevocably agrees that the courts of England and Wales] shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these terms and conditions, their subject matter, or formation.

EXPERIENCE PARTICIPATION TERMS AND CONDITIONS – SWISS-DREAM PARADE

These Experience Participation Terms and Conditions (the "Terms") are entered into between Philip Morris Limited (together with its affiliated companies, "PM") and the individual accepting these Terms (the "Participant", "you", or "your").

These Terms govern the basis on which you may participate in the following Electric Dreams experience in 2026 (the “Participation”): Swiss Dream Parade (Switzerland, 6–9 August 2026).

By accepting these Terms and participating in the Experience, you confirm that you have read, understood, and agree to be legally bound by them.

1. Eligibility, Attendance and Registration

1.1 You warrant and represent that you are 18 years of age or older and that you are an IQOS user. If you do not satisfy these eligibility criteria, you must not accept or participate in the Experience.

1.2 Participation in the Experience is conditional upon (i) your acceptance of these Terms and (ii) confirmation of attendance by the deadline specified in the invitation or related communications.

1.4 For the purposes of the Experience attendance and registration, you agree to provide your mobile telephone number to PM and/or any third party engaged by PM in connection with the organisation or administration of the Experience (the "Contractors").

1.5 You acknowledge that you may be required to complete a registration process and provide certain personal data prior to attending the Experience.

2. Publicity Release

2.1 To the fullest extent permitted by applicable law, you irrevocably grant to PM and any entity that controls, is controlled by, or is under common control with PM (the "Affiliates") the unrestricted right to:

(a) use your name, image, likeness, voice, and biographical information in connection with communications, promotional, and publicity materials relating to the Experience; and

(b) record, film, photograph, and otherwise capture your Participation in the Experience by any means (audio, audiovisual, or otherwise).
