Terms and Condition Trade In Program

1. Application of Terms/Eligibility

a. These terms and conditions (“Terms”) are applicable to and govern your participation in the Trade In program (“Trade In”) to upgrade your tobacco heating system [IQOS 2.4+ or IQOS 3 or IQOS 3 MULTI or IQOS 3 DUO or IQOS ORIGINALS DUO] (“Device”) to the new IQOS ILUMA ONE or IQOS ILUMA. You should read these Terms carefully as they affect your legal rights and govern your relationship with IQOS Indonesia.

b. You are only eligible to this Trade In if: 

(i) You are an IQOS user aged over 18 years old; 

(ii) Members who have registered at IQOS Indonesia latest 30 Maret 2023;

(iii) Your device to Trade In are registered in our IQOS database;

(iv) Your Device is not disarticulated and comprises of the pocket charger and holder (which are each in one part), except for IQOS 3 MULTI; and

c. You are not required to possess the charging cable, original box, or other accessories complimentary to the device to participate in Trade In. 

d. In case you are not an IQOS member, you may register yourself and your device in our database at IQOS.com, by calling customer care 1500-975 or contact.id@iqos.com, meeting our IQOS expert or at IQOS stores.

e. By participating in Trade In, you agree to be bound by these Terms. If you do not agree or cannot comply with these Terms, then you are not permitted to participate in the Trade In Program. No modification of these Terms by you is permitted unless IQOS Indonesia expressly agrees in writing.

f. We also reserve the right to amend these Terms upon notice at any time. 

2. Trade In conditions

a. To get information about channels, where the Trade In is available, contact our customer care center at 1500-975 or visit IQOS.com.

b. The Trade In allows you to receive a special offer on your purchase of IQOS ILUMA ONE, IQOS ILUMA or IQOS ILUMA Stardrift in exchange for you renouncing ownership and returning in your current IQOS device to IQOS Indonesia.

c. The amount of special offer received shall depend on your device warranty status and is only valid with additional purchase of any products at minimum IDR 145k in 1 transaction.

d. If your device is faulty and is still under warranty. You can Trade In your old device to get a special offer for purchasing IQOS ILUMA ONE, IQOS ILUMA or IQOS ILUMA Stardrift based on point 2.b.

e. The devices with the following circumstances are not acceptable for the Trade In:

  • Damage caused by abuse or misuse, or actual, or attempted, modification or alteration of the Device, power surge;
  • Devices with a serial number that has been altered, defaced or removed;
  • Devices that have been opened, serviced, modified or altered in a manner not authorized by IQOS Indonesia.
  • Faulty device and out of warranty period.

f. The special offer determined pursuant to section 2.b shall be valid for the period of your visit in the IQOS Store as the case may be, for a purchase of an IQOS ILUMA ONE kit or IQOS ILUMA kit. In case you refrain from purchasing the IQOS ILUMA ONE kit or IQOS ILUMA kit during that visit in the IQOS booth, IQOS kiosk (except Indomaret), IQOS partner, or activations where the Trade In is available and wish to participate in Trade In at a later stage, the special offer for your device shall be determined during your subsequent visit in the IQOS Store or other channels, where the Trade In is available.

g. Each member at IQOS Indonesia has 1 time opportunity during the 2023 trade in program from all special offers in point 2.b to purchase of 1 IQOS ILUMA ONE, IQOS ILUMA or IQOS ILUMA Stardrift device.

h. Returning a device of a certain color (especially limited edition colors), pursuant to section 2.b of these Terms, does not guarantee the availability to use the applicable special offer for the purchase of a IQOS ILUMA Kit of the same color.

i. When the Trade In transaction is completed, your device will be sent for recycling thus IQOS Indonesia will not be able to return the traded in device should you want to return to the older generation device.

j. Participation in the Trade In program is subject to availability of the IQOS ILUMA ONE, IQOS ILUMA, or IQOS ILUMA Stardrift stock.

k. Termination Your participation in the Trade In is at our discretion and we may refuse your application to participate, or we may terminate your right to participate in the Trade In including if you breach any of these Terms.

3. Miscellaneous

a. The Trade In phase 2 program period is valid from 24th February 2023 and can be stopped anytime without prior notice.

b. IQOS Indonesia shall not be liable to the maximum extent permitted under applicable law whether in tort (including for negligence or breach of statutory duty), contract, misrepresentation, restitution or otherwise for any direct losses, loss of profits, sales, revenues or savings, loss of business, depletion of goodwill and/or similar losses or loss or corruption of data or information, or pure economic loss, or for any special, indirect or consequential loss, costs, damages, charges or expenses however arising or otherwise resulting from your participation in the Trade In. 

c. Use of personal data: When you participate in the Trade In program, IQOS Indonesia will use data about you as described in its privacy notice, available here: https://pmiprivacy.com/en/consumer. This use includes sharing data about you with affiliates of Philip Morris, and to other service providers, in each case which may be either in the same country as you, or in other countries. Our affiliates, and our and their service providers are located in many countries throughout the world, including in particular the EEA, Switzerland, the USA, Canada, India, the Philippines, Indonesia, and Australia. In all cases, appropriate security measures for the protection of personal data will be applied in those countries or territories, in accordance with applicable data protection laws. We implement appropriate technical and organizational measures to protect personal information that we hold from unauthorized disclosure, use, alteration or destruction. Where appropriate, we use encryption and other technologies that can assist in securing the information you provide. We also require our service providers to comply with strict data privacy and security requirements

d. These Terms are subject to the laws of the registered office of IQOS Indonesia . Any legal dispute will be subject to the exclusive jurisdiction of the city in which IQOS Indonesia has its registered office.
