Device Takeback Program Terms & Conditions

I. GENERAL

1. The Device Takeback Program with details provided in Sections II and III below (“Program”) is open to legal age smokers or users of other nicotine-containing products who are at least 18 years old (as of the date of his/her participation in the Program) and above residing in the Philippines (“Customer”), and who otherwise wish to continue to use tobacco or nicotine containing products.

2. The Program is offered in selected participating IQOS Stores (physical). IQOS Stores are operated by ActivAsia Inc. (or "AAI"), the authorized distributor of PMFTC products sold in the IQOS Stores. This Program is being carried out by AAI as an authorized distributor of PMFTC products.

3. The program period of the Device Takeback Program starts on October 3, 2023 across all IQOS Stores nationwide. 

4. PMFTC/AAI reserves the right to modify, change, or revise the rules and mechanics of the Program.

5. Customers using multiple IQOS.com accounts to participate in the Program are disqualified. PMFTC/AAI reserves the right to disqualify any Customer if there is any evidence of fraud or irregularities in his/her participation in the Program.

6. PMFTC/AAI reserves the right to hold, suspend or block a Customer’s IQOS.com account due to suspicious, fraudulent or illegal activity.

7. PMFTC/AAI reserves the right to cancel, amend, or revoke these terms and conditions without notice in the event of fraudulent activity, cheating, a security breach or any anticipated breach of any applicable law or regulation, an event or disturbance outside of PMFTC’s control such as acts of God, civil or military events, catastrophes, technical issues/connectivity, pandemic or war. Any changes to the Offer will be announced accordingly.

9. By participating in the Program, Customer confirms his/her consent to process his/her personal data provided as part of the Program. Details of such processing are described in Philip Morris International’s (PMI) Consumer Privacy Notice found at https://www.pmiprivacy.com/en/consumer and AAI’s Data Privacy Consent Policy.

II. MECHANICS

1. The Device Takeback Programis a recycling sustainability initiative that allows the Customer to dispose used IQOS devices responsibly in any IQOS store.

2. The Customer who has an IQOS device linked to their IQOS account is eligible to participate in the Program. The device to be returned should be linked to the Customer’s IQOS.com account, complete IQOS device kit, genuine and not counterfeit.

3. The Customer can participate in the Device Takeback program either via (i) trading-in a used IQOS device or (ii) voluntary disposal of a used IQOS device.

i. Trading-in a used IQOS device

a. Trade-in is exclusive to IQOS Club Members and follows the terms and conditions of IQOS Club. You may refer to the Trade-in Terms and Conditions.

b. Participation in the Device Takeback Program via trade-in is limited to once per year per tier level as indicated in the Trade-in Terms and Conditions. Should the Customer wish to participate in the Program again, the Customer can opt to voluntary dispose their used IQOS device as referred to in Section II.3.ii (Voluntary disposal of a used IQOS device).

ii. Voluntary disposal of a used IQOS device

a. The Customer participating in the Device Takeback Program may opt to return their old IQOS device without trading-in through voluntary disposal of a used IQOS device.

b. In the voluntary disposal of a used IQOS device, the Customer is eligible to receive an incentive of PHP 250 discount voucher (“Takeback Voucher”). The voucher must be used upon returning the IQOS device in the same IQOS store visit. The voucher can be used in all IQOS stores (physical) nationwide, effective August 4, 2023.

c. The Takeback Voucher is applicable to all IQOS products (device, consumable, accessory). Total purchase value must be greater than PHP 250 to redeem the Takeback Voucher.

d. The Takeback Voucher is non-transferrable and must be used upon returning the IQOS device in the same IQOS store visit.

e. In the event that the Customer voluntarily returns an incomplete IQOS device (holder only, charger only, cable only), the Customer can still opt to dispose the IQOS device at the selected participating IQOS store (physical) but is ineligible of the Takeback Voucher incentive.

f. The Customer is eligible to redeem the Takeback Voucher for every linked, complete, and genuine IQOS device returned/disposed. The Customer is eligible to receive the Takeback Voucher for up to a maximum of five (5) redemptions, effective August 4, 2023.

4. The Customer agrees and understands that participation in the program requires the delinking of the surrendered IQOS device from the Customer’s IQOS.com account.

5. PMFTC and/or AAI reserves the right to verify the Customer’s and his/her IQOS device eligibility in the Program and disqualify any Customer if there is any evidence of fraud or irregularities in his/her participation in the Program.

6. The Customer cannot demand PMFTC and/or AAI for remuneration of the device being surrendered for the Program.

7. In order to participate in the Program thru any of the selected participating IQOS Stores (physical), the Customer will be subject to age verification process wherein he/she will be requested to submit a valid Government Issued ID before items can be purchased and/or delivered to the Customer. The following Government Issued IDs are valid as proof of age: Passport, Alien Certificate of Registration, Driver's License, Firearms License, NBI Clearance Card, Philhealth ID, Postal ID, PRC ID, SSS ID, TIN ID, Unified Multi-Purpose ID or Voter's ID.

III. OTHERS

1. All decisions of PMFTC and/or AAI and its agents in all matters relating to the interpretation and implementation of this mechanics are final, and no objections and/or appeals thereon will be entertained.

2. Customers in the Program agree and confirm the following:

• that you are a legal-age smoker at least 18 years old or above as of the date of his/her participation in the Program;
• that you have read and understood the terms and conditions detailed herein;
• that you agree to follow the applicable mechanics of the Program;
• that you agree to assume all such risks, foreseeable or otherwise, and hereby release and discharge PMFTC and/or AAI, its affiliates and all other persons and entities connected with the Program from any liability for, or any claims that may arise in respect of, any and all property losses and/or injuries whatsoever that you may sustain, no matter how any such property losses and/or injuries are caused.

4. PMFTC will not be liable to the Customer for any taxes, costs, liabilities or expenses that may arise from this Offer.
