MECHANICS: PMFTC IQOS Club Birthday Offer
I. GENERAL
1. The PMFTC IQOS Club Birthday Offer (“Offer”) is open only to IQOS Club Members who have made at least one (1) linked IQOS device in their IQOS.com account (“Customer”).
2. IQOS Club Members are legal age users who are at least 18 years old (as of the date of his/her participation in the Offer) and above residing in the Philippines who otherwise wish to continue to use tobacco or nicotine containing products. 3. The Promotion is available in IQOS.com and IQOS Official Stores. IQOS Stores are operated by ActivAsia Inc. (or "AAI"). IQOS.com is owned by Philip Morris International and its affiliate in the Philippines, PMFTC Inc ("PMFTC"). The online store of IQOS.com is operated by AAI, and all orders are fulfilled by AAI, as an authorized distributor of PMFTC products sold in IQOS Stores and IQOS.com. Deliveries are carried out by AAI or by AAI’s authorized third-party delivery providers. This Program is being carried out by AAI as an authorized distributor of PMFTC products.
4. The Offer period is from March 9, 2021 to January 31, 2022. PMFTC/AAI has the sole discretion to shorten or extend the Offer period if circumstances so warrant.
5. PMFTC/AAI reserves the right to modify, change, or revise the rules and mechanics of the Offer.
6. Customers using multiple IQOS.com accounts to participate in the Offer will be disqualified. PMFTC/AAI reserves the right to disqualify any Customer if there is any evidence of fraud or irregularities in his/her participation in the Offer.
7. PMFTC/AAI reserves the right to hold, suspend or block a Customer’s IQOS.com account due to suspicious, fraudulent or illegal activity.
8. PMFTC/AAI reserves the right to cancel, amend, or revoke these terms and conditions without notice in the event of fraudulent activity, cheating, a security breach or any anticipated breach of any applicable law or regulation, an event or disturbance outside of PMFTC’s control such as acts of God, civil or military events, catastrophes, technical issues/connectivity, pandemic or war. Any changes to the Offer will be announced accordingly.

II. MECHANICS
1. The Offer is a one-time offer wherein Customers, on their birth month can receive any of the following, subject to availability:
· Php 500 IQOS Voucher (“Php 500 IQOS Voucher”) plus one (1) free pack of HEETS upon use of voucher; variant is subject to availability
· An IQOS Device Voucher (“IQOS Device Voucher”) to claim an IQOS device (subject to availability) plus one (1) free pack of HEETS upon use of voucher; variant is subject to availability
· An IQOS Accessory Voucher (“IQOS Accessory Voucher”) to claim an IQOS accessory (subject to availability) plus one (1) pack of HEETS upon use of voucher; variant is subject to availability
· A Dinner Voucher (“Dinner Voucher”) for a meal for two (2) at one of the following restaurants; and such other restaurants from time to time:
o The Penthouse 8747, Makati
o Dillingers 1903 Steak and Brew, Makati
o Gaja Korean Kitchen, Makati
o Tipsy Pig, BGC
o Katsu, BGC
o Yes Please, BGC
o Reserve Gastro Tavern, BGC
2. On the start of their birthday month, Customers will receive an email providing for the complete promo mechanics (“Main Email”). The Customer must then click on “HAPPY BIRTHDAY!” button on the email. Customer will be redirected to a landing page containing the details of the item they received. Customer will receive a second email containing the voucher to be used. Note that only Customers who have opted-in to receiving marketing communications via e-mail will be able to receive emails pertaining to the promotion.
3. The applicable voucher (i.e. Php 500 IQOS Voucher or IQOS Device Voucher or IQOS Accessory Voucher or Dinner Voucher) will be sent to Customer’s registered email. Vouchers will only be sent to Customers who clicks on the “HAPPY BIRTHDAY!” button on the Main Email until the end of their birthday month.
4. Only one voucher (i.e. Php 500 IQOS Voucher or IQOS Device Voucher or IQOS Accessory Voucher or Dinner Voucher) will be sent to the Customer. Only one voucher (i.e. Php 500 IQOS Voucher or IQOS Device Voucher or IQOS Accessory Voucher or Dinner Voucher) can be used per Customer. Customers cannot request for their voucher to be exchanged with a different type of voucher.
5. The vouchers (i.e. Php 500 IQOS Voucher or IQOS Device Voucher or IQOS Accessory Voucher or Dinner Voucher) are redeemable up until the 15th of the month after the Customer’s birth month. (e.g. Customer’s birth month is April, the vouchers (i.e. Php 500 IQOS Voucher or IQOS Device Voucher or IQOS Accessory Voucher or Dinner Voucher) can be used until May 15, 2021)

6. Customers can use the Php 500 IQOS Voucher, IQOS Accessory Voucher or IQOS Device Voucher in any of the following points-of-sale:
· Official IQOS Stores
· IQOS.com (online store)
7. For IQOS.com transactions, Customers must input the Php 500 IQOS Voucher or IQOS Accessory Voucher or IQOS Device Voucher in the promo section of the check-out page in IQOS.com.
8. For IQOS Official Stores, Customer must provide the Php 500 IQOS Voucher or or IQOS Accessory Voucher IQOS Device Voucher to IQOS Sales Experts or IQOS Coaches for use upon check-out.
9. The Php 500 IQOS Voucher or IQOS Accessory Voucher or IQOS Device Voucher cannot be combined with other special offers, promotions or vouchers.
10. For Php 500 IQOS Voucher or IQOS Accessory Voucher or IQOS Device Voucher, the Customer will be subject to age verification process wherein he/she will be requested to submit a valid Government Issued ID before items can be purchased and/or delivered to the Customer. The following valid Government Issued IDs as proof of age: Passport, Alien Certificate of Registration, Driver's License, Firearms License, NBI Clearance Card, Philhealth ID, Postal ID, PRC ID, SSS ID, TIN ID, Unified Multi-Purpose ID or Voter's ID.
11. The IQOS.com website may be subject to possible technical and system issues. We will provide the necessary notice to the Customers if such is the case.
12. For orders using the Php 500 IQOS Voucher or IQOS Accessory Voucher or IQOS Device Voucher that lead to failed transactions (e.g. order cancellation, failed payment, failed delivery, etc), Customers may request for a one-time replacement voucher (Php 500 IQOS Voucher or IQOS Accessory Voucher or IQOS Device Voucher) from IQOS Customer Care, subject to the following:
· Review of the failed transaction (e.g. accidental order cancellation, unavailability of the Customer during delivery, etc)
· Customer’s eligibility and compliance with the requirements stated in Section I.1
If still eligible, IQOS Customer Care will send the replacement code to the Customer’s nominated email address as reflected in IQOS.com. It is the responsibility of the Customer to update his/her personal details in their IQOS.com account to ensure timely receipt of the replacement code. PMFTC shall not be liable for any failure of a Customer to redeem or use the code and will not refund the code due to non-receipt by the Customer of the replacement code, if sent to his/her registered email address.
Dinner Voucher
13. The Customer must present the Dinner Voucher to restaurant’s waitstaff. Restaurant waitstaff will confirm if the Dinner Voucher is still valid for redemption i.e. not used and is still within redemption period.
14. The Dinner Voucher can be used to purchase food and drinks worth up to Php 2,500 only. Any orders on top of said amount must be shouldered and paid for by the Customer.
15. The Dinner Voucher is not transferable and not convertible to cash.
16. The Dinner Voucher can only be used in full in a single transaction. Any amount not used cannot be exchanged for cash or another Dinner Voucher, and will be automatically forfeited.
17. The Dinner Voucher can only be redeemed 3pm onwards.
18. The Dinner Voucher cannot be used to purchase any type of alcoholic drinks.
19. Customer’s companions, upon use of Dinner Voucher, must be 18 years old and above.
20. For Dinner Vouchers, the Customer and companion will be subject to age verification process wherein they will be requested to present a valid Government Issued ID before Dinner Voucher can be used. The following valid Government Issued IDs as proof of age: Passport, Alien Certificate of Registration, Driver's License, Firearms License, NBI Clearance Card, Philhealth ID, Postal ID, PRC ID, SSS ID, TIN ID, Unified Multi-Purpose ID or Voter's ID.
21. The Customer, upon use of the Dinner Voucher, must sign Consent and Release Form issued by the respective restaurants.
22. Dinner Voucher availability and guidelines are subject to community quarantine restrictions, local government regulations and other applicable government regulations issued from time to time.
III. DELIVERY (for IQOS.com online store)
1. Customer will be subject to age verification process where he/she will be required to present a valid Government Issued ID before the Php 500 IQOS Voucher or IQOS Device Voucher can be claimed.
2. To facilitate the purchase and delivery from IQOS.com, Customer must present any of the following valid Government Issued IDs as proof of age: Passport, Alien Certificate of Registration, Driver’s License, Firearms License, NBI Clearance Card, Philhealth ID, Postal ID, PRC ID, SSS ID, TIN ID, Unified Multi-Purpose ID or Voter’s ID.
3. In cases where Customer cannot accept the delivery, an authorized representative who is at least eighteen (18) years old and above can claim on behalf of the Customer provided the following documents are presented to the courier:
· Valid government issued ID of representative for identity check and age verification
· Copy of a valid government issued ID of Customer for identity check and age verification
· Signed authorization letter stating that the Customer is authorizing the representative to receive the items stated in the order plus HEETS pack and order reference number.
The courier will not be able to deliver the Customer’s orders and HEETS pack if any of the above-required documents are not presented.
4. For deliveries, the courier will communicate and coordinate details, with delivery attempt at a maximum of two (2) times. A third delivery attempt will be available in selected cities that offer same/next day delivery; and can be arranged with an additional delivery fee that will be communicated in advance by AAI/courier, and to be confirmed by the Customer. In the event of failure to receive the delivery for credit card or GCash transactions, normal refund process will be followed:
a. For credit card transactions:
i. For Credit Cards issued locally: Refund will take up to 10 working days but also subject to issuing bank lead times
ii. For Credit Cards issued abroad: Refund will take up to 45 days, but also subject to issuing bank lead times
You may check the status of your refund with your issuing bank.
b. For GCash transactions, refund must be coursed through IQOS Customer Care team. The Customer shall call IQOS Customer Care team to trigger the refund process and will be able to credit back to the Customer’s GCash account real time.
5. In instances of non-eligibility of the Customer to avail of the Php 500 IQOS Voucher or IQOS Device Voucher, Customers who opted to pay in credit or through GCcash will follow standard refund process as stated in Section III.4.a – b.
IV. OTHERS
1. All decisions of PMFTC and/or AAI and its agents in all matters relating to the interpretation and implementation of this mechanics are final, and no objections and/or appeals thereon will be entertained.
2. Customers in the Offer agree and confirm the following:
· that you are a legal-age smoker at least 18 years old or above as of the date of his/her participation in the Offer;
· that you have read and understood the terms and conditions detailed herein;
· that you agree to follow the applicable mechanics of the Offer;
· that you agree to assume all such risks, foreseeable or otherwise, and hereby release and discharge PMFTC and/or AAI, its affiliates and all other persons and entities connected with the Offer from any liability for, or any claims that may arise in respect of, any and all property losses and/or injuries whatsoever that you may sustain, no matter how any such property losses and/or injuries are caused.

4. Devices bought by Customers using IQOS Store e-vouchers, special offers or through promotional activities are non-refundable.
5. PMFTC will not be liable to the Customer for any taxes, costs, liabilities or expenses that may arise from this Offer.
