NEW HORIZONS: AN EVENING OF DELIGHT (“Event”) is a private event/program and is strictly intended for IQOS CLUB Members and adults 21 years old and above.
By registering, entering, and by your presence at NEW HORIZONS: AN EVENING OF DELIGHT (“Event”), you confirm that:
1. You are an adult who is at least 21 years old (as of June 24, 2022);
2. You are giving your express consent to PMFTC and/or its representatives or agents to:
a. Interview, photograph, and film you;
b. Use your name, image, likeness, video, and voice in all advertising, promotional, and publicity material developed by PMFTC or a PMFTC affiliate in such manner as the latter may deem fit, including the right to edit or alter the same, without the need of any payment or compensation to you;
c. Collect and process your personal data for three (3) years; and
d. Retain your personal data for three (3) years.
3. You understand that you are entitled to certain rights in relation to the personal data collected from you, including the right to access, correct, and object to the processing, as well as the right to lodge a complaint before the National Privacy Commission in case of violation of your rights as a data subject;
4. You understand that the activities, promotions, and/or campaigns presented in this activity/venue do not serve as a prompt or request, direct or indirect, for you to share any content through any social media channels;
5. You understand that you are highly discouraged to share on any social media channel posts (image or text) or hashtags related to our brands and/or products, this activity, promotion, and/or campaign created by us in any activity or event you may have attended as our guest.
If you do not agree to the foregoing, please do not enter the Event area.

TERMS & CONDITIONS
1. Participant Requirements
a. Participants. New Horizons: An Evening of Delight (“Event”) is open only to selected IQOS CLUB Members who have at least one (1) linked device to their IQOS account and have made at least one (1) purchase either in IQOS.com or any official IQOS retail store (“Participant”).
i. IQOS CLUB Members are adult nicotine users who are at least 21 years old (as of June 24, 2022) residing in the Philippines who otherwise wish to continue to use tobacco or nicotine-containing products. ii. To help create a better shared experience, each Participant has the option to bring a companion to the Event, provided said companion is at least 21 years old as of June 24, 2022.
b. Access. Participants will get a chance to join the Event through an invitation to be sent to their registered email in IQOS.com. Seats are limited and only the first 100 Participants to confirm attendance will be allowed access to the Event.
c. Content. The Participant acknowledges and agrees that PMFTC Inc. in its sole discretion, reserves the right to change any and all aspects of the Event, including but not limited to the event name, themes, content, program, performers, hosts, moderators, venue, and time. Event content shall be recorded by PMFTC Inc. and/or its service providers.
d. Use of Likeness. By participating in the Event, the Participant acknowledges and agrees to grant PMFTC Inc. and/or its authorized service providers the right to record, film, live stream, photograph, or capture his likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval or any payment to the Participant. This grant includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to use or disseminate the media.
2. Registration Confirmation
a. Invitation. An invitation will be sent to Participant’s registered email as provided in IQOS.com. If Participant is interested to attend the Event and meets all the requirements, he must:
i. Confirm attendance by clicking the RSVP button on the invitation sent to his registered email address in IQOS.com; and
ii. Accept Event Terms & Conditions.
b. Updates. Participant will receive all essential information about the Event for registered attendees electronically via email and/or SMS.
c. Event Link. The Participant agrees that PMFTC Inc. and/or its authorized service provider will register him to the Event using his email registered in IQOS.com.
3. Prohibited Conduct
a. Attendance. Once his attendance is confirmed, each Participant will be allotted two (2) seats to the Event, thus giving him the option to bring a companion to the Event, provided said companion is at least 21 years old as of June 24, 2022.
b. Limitations on Use. By joining the Event, Participant agrees not to sell, transfer, or share their access to the Event. If PMFTC Inc. determines that they have violated this policy, PMFTC Inc. may cancel access and ban the Participant from future IQOS events.
c. Disruptive Conduct and Unethical/Non-Compliant Behavior. The Participant acknowledges and agrees that PMFTC, Inc. and/or its authorized service providers reserve the right to remove them from the Event if PMFTC Inc. and/or its authorized service providers in its sole discretion, determines that their participation or behavior creates a disruption or hinder the continuity of the Event or the enjoyment of the Event content by other attendees. PMFTC Inc. and/or its authorized service providers also reserve the right to deny participation to anyone who engages in or is reputed to engage in unethical or non-compliant behavior during the Event.
d. Recording, Live Streaming, and Videotaping. Participant agrees not to record or broadcast audio and/or video any part of the Event. The use or attempt to use of an audiovisual recording device to record, reproduce and/or distribute any part of this website during the event/program without proper consent is prohibited by law.
e. In addition to the requirements and prohibitions set forth in this Section 3, PMFTC Inc. may also exclude any prospective Participant from registering or participating in any IQOS event in PMFTC Inc.’s sole discretion.
4. Event Requirements
a. Prior to being allowed inside the Event, Participant must confirm his identity and age by presenting a government-issued ID to PMFTC Inc. and/or its authorized service providers. Valid and acceptable IDs include Passport, Alien Certificate of Registration, Driver's License, Firearms License, NBI Clearance Card, PhilHealth ID, Postal ID, PRC ID, SSS ID, TIN ID, Unified Multi-Purpose ID, Voter's ID. Only those at least 21 years old (as of June 24, 2022) shall be allowed inside the Event premises.
b. Participant’s companion, if any, must likewise present a government-issued ID to PMFTC Inc. and/or its authorized service providers in order to confirm his age.
c. Participant should ensure that for the duration of the Event, that there are no persons below 21 years old who will be able to view the Event.
d. Use of IQOS will be allowed in designated vaping areas during the Event.
5. Event Souvenir
a. As a token from the Event, each Participant will be eligible to receive a souvenir from PMFTC Inc. The souvenir will be distributed by PMFTC Inc.’s authorized service provider during the Event. Thus, absence from the Event disqualifies a Participant from receiving the souvenir.
b. The Participant understands that the souvenir is an engagement activity intended to thank IQOS CLUB Members for their loyalty. Participants should not consider the souvenir, or any activity related to it, as prompt or a request, direct or indirect, to share any content through any social media channels. With this in mind, the Participant should not share on any social media channel any posts (including images and texts) related to PMFTC Inc.’s brands and products, and this souvenir.
c. All intellectual property rights in and to the souvenir, the content, and all materials distributed at or in connection with the souvenir are owned by PMFTC Inc. Participant may not use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing in the souvenir without the prior written permission of PMFTC Inc.
d. Souvenir is limited to one per Participant.
6. Cancellation
a. If PMFTC Inc. and/or its authorized service providers are prevented from staging the Event for as a result of any cause beyond its control, or such Event cannot be virtually conducted because of a software or issue with the hosting platform or due to acts of God, strikes, labor disputes, government requisitions, restrictions or war or apparent act of war, terrorism, disaster, civil disorder, epidemic or pandemic, curtailment or restriction on transportation facilities, or any other comparable calamity, casualty or condition (collectively a “Force Majeure”), PMFTC Inc. shall have the right to cancel or immediately terminate the Event without liability to the Participant.
7. Data Privacy Consent
a. By participating in the event and agreeing to these Terms & Conditions, Participant also confirms his/her consent to Philip Morris International’s Consumer Privacy Notice https://www.pmiprivacy.com/en/consumer.
b. The Participant understands that they are entitled to certain rights in relation to the personal data collected, including the right to access, correct, and object to the processing, as well as the right to lodge a complaint before the National Privacy Commission of violation of your right as a data subject. consistent with Philip Morris International’s Consumer Privacy Notice https://www.pmiprivacy.com/en/consumer.
8. Intellectual Property and Social Media Guidelines
a. All intellectual property rights in and to the Event, the content, and all materials distributed at or in connection with the Event are owned by PMFTC Inc. Participant may not use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing at Event, in any Event content or in any materials distributed at or in connection with the Event for any reason without the prior written permission of PMFTC Inc.
b. The Participant understands that this Event is a private activity intended to provide IQOS CLUB Members with the opportunity to enjoy an exclusive experience. Participants should not consider this Event or any activity related to it as prompt or a request, direct or indirect, to share any content through any social media channels. With this in mind, the Participant should not share on any social media channel any posts (including images and texts) related to PMFTC Inc.’s brands and products, and this Event.
9. Disclaimer of Warranties, Limitation of Liability
a. PMFTC Inc. and its authorized service providers shall not be liable for any illness that may arise from the Participant’s willful consumption of food and/or drinks from the Event.
b. Except as required by law, neither PMFTC Inc. nor its affiliates shall be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the Event or other aspect related thereto or in connection with these Terms & Conditions.
c. The Participant agrees to assume all such risks, foreseeable or otherwise, and hereby release and discharge PMFTC Inc. its affiliates and all other persons and entities connected with the Event from any liability for, or any claims that may arise in respect of, any and all property losses and/or injuries whatsoever that the Participant may sustain, no matter how any such property losses and/or injuries are caused.
d. The Event, or any activity related to it, shall not be taken as precedent for future IQOS promotions.
