General Terms and Conditions

 

The following General Terms and Conditions also contain legal information about your rights in line with the legal provisions regarding distance sale contracts and e-commerce.

 

1 Scope of application, contract partners, delivery restrictions

 

1.1 These General Terms and Conditions (“GTC”) apply to all contracts concluded between you as customer (“you”) and Philip Morris GmbH ("Philip Morris") as the operator of the online shop at https://www.iqos.com/de (“IQOS Webshop”). By placing an order, you are accepting the version of the GTCs valid at the time the order is placed. Deviating or supplementary general terms and conditions of the customer will only apply if Philip Morris has agreed to them in writing in an individual case.

 

1.2 These GTCs apply exclusively for consumers. According to the legal definition, a consumer is any natural person who concludes a legal transaction for purposes which cannot be largely attributed to commercial activity or professional activity under self-employment.

 

1.3 Your contract partner is Philip Morris Gesellschaft mit beschränkter Haftung, Am Haag 14, 82166 Gräfelfing, Germany, registered with the commercial register of Munich District Court under number HRB 49432. If you have any questions, requests, or complaints, then please contact Philip Morris at 0800 1114767 (free of charge) or via e-mail at contact.de@iqos.com.

 

1.4 The following supply restrictions apply:

 

Philip Morris exclusively supplies consumers who have reached the age of 18, have their primary residence (billing address) in the Federal Republic of Germany, and specify a German delivery address (with the exception of Helgoland, Kleinwalsertal, and Büsingen).

 

2 Registration, contract conclusion

 

2.1 To order items from the IQOS Webshop (“Products”), you must have a password-protected customer account, which you’ll need to create at www.iqos.com. If you already have an IQOS customer account, then you’ll need to log into that account for your order. If you do not yet have an IQOS customer account, then you must register for one. You must be at least 18 years old to do so. You are required to enter your personal information truthfully and to keep your chosen password strictly confidential to ensure that it does not fall into the hands of any third party. You may not disclose your password nor in any other way provide a third party with access to your IQOS customer account in the IQOS Webshop. Details on the collection and use of your personal data are laid out in the Philip Morris Privacy Policy, available at https://www.pmiprivacy.com/de/consumer. As Philip Morris takes the protection of minors seriously, you are also asked to ensure that products are not used by persons who have not reached the age of 18.

 

2.2 For certain products, you’ll have the option either to purchase the products directly or to order the products for trial purposes (“IQOS trial month”) in line with the provisions under Section 9 here.

 

2.3 The presentation of products in the IQOS Webshop does not constitute a binding offer of sale. The offer to conclude a purchase contract is made by you as the customer by finalizing the payment process using your chosen payment method. If you have chosen a credit card as the payment method, then you can complete the payment process after entering the required payment information directly in the IQOS Webshop by clicking on the button “submit order” (“Bestellung Aufgeben”) button. Should you choose PayPal, Sofortkauf, or Klarna as the payment method, then after clicking on the button “PayPal” for PayPal, “Continue to Sofort” (“Weiter zu Sofort”) for Sofortkauf, or “Continue to Klarna” (“Weiter zu Klarna”) for Klarna, you will be redirected to the website of the respective service provider directly and complete the payment process on the corresponding service provider website. Philip Morris can accept your offer by dispatching the products within five business days. Confirmation for the receipt of your order will be sent by automated e-mail immediately after your order is submitted; this does not yet constitute contract acceptance by Philip Morris.

 

3 Delivery, availability of items, right of revocation

 

3.1 Delivery is exclusively carried out within Germany and via parcel service (post office or courier) in conjunction with visual age verification. The deliverer will verify the age of the receiving individual (recipient or other person authorized to receive mail) by means of official photo identification. This can be omitted if the deliverer is clearly able to assume that the receiving individual has reached the minimum age based on the overall circumstances. Age will not be documented. If there is no adult person available at the household, then the parcel cannot be delivered and must be picked up by the recipient in person at a parcel store (not a “Packstation”). Delivery will not be made to neighbors or other building residents. The shipping risk is borne by Philip Morris.

 

3.2 If an ordered product is not available because Philip Morris has not been supplied with the product by its suppliers through no fault of its own, then Philip Morris may withdraw from the contract. In such case, Philip Morris will inform you without delay and refund any payment already made.

 

4 Pricing, shipping costs

 

4.1 The final prices stated in the IQOS Webshop include value added tax as required by law and all other price components.

 

4.2 Delivery is free of shipping costs.

 

5 Payment, reservation of title

 

5.1 Payment can generally be made by credit card (American Express, Mastercard, and Visa), PayPal, Klarna (purchase on account, payment by installments), or by SOFORT transfer. For payment via credit card, Klarna, and SOFORT bank transfer, the payment process is supported by Adyen N.V., Simon Carmiggeltstraat 6-50, 1011 DJ, Amsterdam, Netherlands. Payment via PayPal is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22- 24 Boulevard Royal, L-2449 Luxembourg. The charge will be made to your chosen payment method following successful authorization. The respective terms and conditions of the payment service providers will apply.

 

5.2 Additionally, you can purchase products in the IQOS Webshop using IQOS POINTS if you are an IQOS CLUB member, are logged into IQOS CLUB, and have collected IQOS POINTS. In the event you do not have sufficient IQOS POINTS available, you can make a payment to cover the difference. It is not possible to have IQOS POINTS converted into cash or paid out in cash. IQOS POINTS cannot be redeemed for tobacco products. Your IQOS POINTS account will be charged immediately when you redeem your IQOS POINTS in the IQOS Webshop.

 

5.3 Until payment has been made in full, the supplied products will remain the property of Philip Morris.

 

6 Right to revocation

 

6.1 Consumers will have a legal right to revocation when concluding distance sale transactions. In the following, Philip Morris is providing information on such right in accordance with the legal model. You’ll find a model revocation form in Section 6.2. Furthermore, Section 6.3 lays out clarifications for the legal models, as well as supplementary provisions to your benefit which Philip Morris has bound itself to on top of the statutory right.

 

Notice regarding revocation

Right to revocation

You have the right to revoke this contract within fourteen days without indicating grounds.

The revocation period is fourteen days from the date on which you or a third party designated by you, other than the carrier, took possession of the items. If you have ordered multiple items as part of a single order and those items are delivered separately, then the revocation period will be fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the last item.

To exercise your right to revocation, you must contact us (Philip Morris GmbH, Am Haag 14, 82166 Gräfelfing, tel: 0800 1114767 (free call) e-mail: contact.de@iqos.com) by means of a clear declaration (e.g. a letter sent by mail, fax, or e-mail) regarding your decision to revoke the contract. You can use the attached model revocation form to that end, although using the form is not mandatory.

In order to comply with the revocation period, it is sufficient that you send the notification about exercising the right to revocation before the revocation period expires.

Consequences of revocation

If you revoke this contract, we (Philip Morris GmbH) must return to you all payments we have received from you, including any potential delivery costs (with the exception of additional costs incurred due to you having chosen a type of delivery other than the most economical standard delivery we offered), without delay and no later than within fourteen days from the day on which the notification regarding your withdrawal from this contract was delivered to us. For this refund, we will use the same method of payment used by you for the original transaction, unless otherwise expressly agreed with you; in no event will you be charged for the refund. We may refuse to refund your payment until we have received the items back from you or until such time as you have provided evidence that you have returned the items, whichever case is earlier.

You must send back or hand over the items to us (Arvato Supply Chain Solution SE, Marler Str. 181, 46282 Dorsten) without delay and by no later than within fourteen days of the day on which you notify us of contract revocation. This period will be deemed to have been observed if you dispatch the items before the expiration of the fourteen-day period.

You will bear the direct costs of returning the items. You will be liable for any loss in the value of items only if such devaluation is due to handling of the items beyond that which is necessary in order to examine their nature, properties, and functionality.

6.2 Philip Morris uses the sample withdrawal form to provide you with information in line with the statutory provisions as follows:

6.3 In supplement to the legal provisions and in the interest of clarification, and furthermore exclusively to your benefit:

 

(a) In principle, you will be responsible for the direct costs of returning the items in the event of revocation. However, this will not apply if you use a return label provided by Philip Morris, which you can request either via your customer profile at iqos.com, by calling the toll-free number 0800 1114767, or via e-mail (contact.de@iqos.com). In this case, Philip Morris will cover the costs of the return shipment.

 

(b) The right to revocation does not exist under law for contracts for the supply of sealed items which are not suitable for return for reasons of health or hygiene if their seal has been removed after delivery. Accordingly, the right to revocation in the IQOS Webshop does not apply to any (individual) pack of sealed HEETS from which the seal was removed after delivery. If you ordered the individual packages for which the seals were removed as part of a larger package, then you may limit your revocation to the individual packages whose seals were not removed after delivery, in which case Philip Morris will refund the purchase price pro rata.

 

7 Statutory warranty and voluntary warranty

 

7.1 Your rights in the event of material and title defects will be governed by the applicable statutory provisions. Philip Morris will only assume liability for damages in accordance with Section 8.

 

7.2 In addition, Philip Morris grants you a limited manufacturer’s warranty for certain products. The products for which the manufacturer warranty is granted as well as the warranty conditions can be found in the IQOS Webshop. Your statutory warranty rights with respect to Philip Morris are not affected by the manufacturer warranty.

 

7.3 IQOS Care Plus Services

 

7.3.1 Scope of application / eligibility

 

7.3.1.1 Philip Morris may deny use of IQOS Care Plus Services at any time if you violate these Terms and Conditions of Eligibility.

 

7.3.1.2 You are only entitled to use IQOS Care Plus Services if: you are an adult IQOS user, have an IQOS customer account, and your IQOS device is registered (Section 7.3.2);

 

7.3.1.3 We reserve the right to modify these Terms and Conditions at any time and will inform you accordingly.

 

7.3. 2 Eligible devices / Registration

 

7.3.2.1 Only the following device models can be registered for IQOS Care Plus Services: IQOS 2.4, IQOS 2.4 Plus, IQOS 3, IQOS 3 MULTI, IQOS 3 DUO, and all successor models; the device must have a legible and valid serial number.

 

7.3.2.2 IQOS Care Plus Services are activated upon registration of your IQOS device. Device registration is carried out either via iqosplus.com (independent customer and device registration), IQOS.com (device registration during customer account creation when purchasing a device on IQOS.com), or via an area manager (device registration during customer account creation when purchasing a device via an area manager).

 

During the (device) registration process, you must provide all requisite information correctly and completely. During the (device) registration process, you will have the option to correct entry errors at any time. Following the (device) registration process, you will be informed whether registration was successful. If registration has been successfully performed, then you will automatically be entitled to the services described in Sections 7.3.3 and 7.3.4 (IQOS Care Plus Services). The IQOS Care Plus Services provided are exclusively available to you personally; they cannot be transferred to third parties.

 

7.3.2.3 The ability to make claims for a device under IQOS Care Plus Services is linked to the (remaining) term of the voluntary manufacturer warranty for that device.

 

7.3.2.4 Your use of IQOS Care Plus Services is linked to the country of your primary residence, i.e. the Federal Republic of Germany. Since IQOS Care Plus Services are only available in certain countries, you must notify us if your country of primary residence changes and re-register your device in your new country of primary residence.

 

7.3.3 Coverage for accidental damage (full coverage / accident coverage)

 

7.3.3.1 If your device is damaged accidentally, i.e. unintentionally, and the functionality of your device is impaired as a result, then you may be entitled to a replacement device in accordance with this Section 7.3.3 provided that the damage is not due to misuse or gross negligence on your part (accidental damage).

 

7.3.3.2 If you give the damaged device (including all components) over to Philip Morris, then you will be provided with a replacement IQOS device of the same type that is equivalent to a new device in terms of performance and reliability. In the event a replacement IQOS device of the same type is not available, an IQOS device that is at least functionally equivalent to your device will be provided to you as a replacement. Philip Morris will keep devices which have been given over for replacement. However, if only one part of the device is damaged, such as the holder or the charger, then Philip Morris will only replace the damaged part and will only keep the part of the device which has been replaced.

 

7.3.3.3 Limitations regarding coverage in the event of accidental damage

 

(a) You must take all reasonable precautions to protect your device and use and maintain the device in accordance with the manual. If you do not, then you will not be entitled to a replacement device.

 

(b) Your right to a replacement device in the event of accidental damage is limited to one replacement device per registered device. Once you have received a replacement for a registered device, then the entitlement to accident damage coverage and the associated entitlement to replacement will have been met for that device. Notwithstanding the foregoing, you may continue to receive the remaining services (international support, see Section 7.3.4, and any additional service which may be included in IQOS Care Plus Services at a later time) for the device until expiration of the manufacturer warranty applicable to the particular IQOS device. Warranty rights laid out in law will remain unaffected.

 

(c) You will not be entitled to a replacement device in the following cases:

 

(i) The device is a product which is not included in the list under Section 7.3.2.1;

(ii) Damage due to misuse or abuse, or due to any actual or attempted modification or alteration to the device for which you are responsible, or damage due to a power surge;

(iii) Devices with a serial number which has been altered, rendered illegible, or removed;

(iv) Devices which have been opened, serviced, modified, or altered in a manner not authorized by Philip Morris;

(v) Loss or theft of your device;

(vi) Damage to the appearance of your device which does not affect the functionality of the device, including hairline cracks, scratches, dents, plastic breakage at the connection points, and discoloration;

(vii) Damage or malfunction due to normal wear and/or use of the device;

(viii) Improper handling, fire damage, damage caused by floods or natural disasters, war, terrorism or force majeure;

(ix) Malfunctions due to use with a non-compatible product;

(x) Damage or malfunction due to use of the device in a manner not in accordance with the manual, or

(xi) Malfunctions due to defects in materials and/or workmanship and/or design; however, such malfunctions may be covered by your other statutory consumer/warranty rights or the voluntary manufacturer warranty, which apply concurrently; all other rights and remedies under applicable consumer protection laws will also remain unaffected.

 

7.3.3.4 Making a claim due to accident damage

 

(a)    To receive service under accidental damage coverage, you must:

 

(i) Notify Philip Morris of the claim via the website IQOS.com, at one of the IQOS Stores, or via the Customer Service Center by calling the telephone number listed on IQOS.com for Germany as soon as your device has incurred accidental damage and provide the following information: (1) Serial number of the corresponding device; (2) Description of symptoms, problems with the device, or reasons for damage to the device; (3) Error messages; and (4) Measures taken before the device began incurring problems and the steps you have taken to resolve the problem;

(ii) Upon request from Philip Morris, a purchase receipt for your device. If no purchase receipt is available, then Philip Morris will use the manufacturer’s packaging date on the basis of the serial number. In such case, the date of purchase will be calculated by adding three months to the manufacturer’s packaging date;

(iii) Follow Philip Morris’ packaging and shipping instructions for shipping the corresponding device to Philip Morris; and

(iv) Follow the other provisions of Philip Morris’ authorization process for returning devices.

 

(b)    You may not send Philip Morris products and accessories which are not covered under the replacement program for accidental damage. If you do send such products to Philip Morris, then they will not be returned and will be destroyed.

 

(c)     Philip Morris will review whether you are entitled to a replacement device in accordance with these Terms and Conditions of Eligibility. If you are entitled to a replacement device, then you can choose among the following alternatives:

 

(i) Postal delivery: A replacement device will be mailed to you, and you must return the defective device to Philip Morris. To such end, Philip Morris will provide you with a prepaid return label so that you will be able to send the defective device or equipment to Philip Morris.

 

(ii) IQOS Store: You can return your defective device to a participating IQOS Store, where a replacement device will be provided to you.

 

(d) If you wish to request a replacement device in a country other than the country of purchase, then you must comply with all applicable import and export rules and regulations, and you will be liable for any customs duties, sales tax, and other applicable taxes and duties which may be associated with delivery.

 

7.3.4 International support (worldwide warranty)

 

7.3.4.1 If you are traveling to countries where IQOS is distributed by Philip Morris, Philip Morris affiliates, or an authorized partner, there is an international toll-free number available: +800 2559 2559 (fees may apply in some locations); see IQOS.com for a list of applicable countries. This service includes troubleshooting assistance from experienced IQOS representatives and, if necessary, replacement of your device (i) under the Accidental Damage Coverage Program in accordance with these Terms and Conditions of Eligibility, and/or (ii) in cases where you have statutory rights based on defects (i.e., in particular, defects in materials, workmanship, and design) and/or (iii) in cases where you are entitled to claims under the voluntary manufacturer warranty.

 

7.3.4.2 The specific service scope, device availability, and response and delivery times may vary from country to country. This service has no effect on your statutory rights regarding defects nor your rights under the voluntary manufacturer warranty, which are valid concurrently.

 

7.3.4.3 Restrictions regarding international support:

 

(a) The limitations cited in Section 7.3.3.3 also apply for device replacement due to accidental damage within the scope of international support, with the exception of Section 7.3.3.3 (c) xi).

 

(b) The following circumstances preclude replacement of an IQOS device (i) in cases where you invoke statutory defect rights and (ii) in cases where you invoke claims under the voluntary manufacturer warranty:

(i) Damage due to normal wear and tear;

(ii) Damage to outward appearance (such as scratches, dents, broken plastic, etc.)

(iii) Damage due to misuse, power surges, improper handling, or fire;

(iv) Malfunctions due to use with a non-compatible product;

(v) Damage or malfunction due to an attempt to open, modify, and repair the device by either the user or a service provider not approved by the manufacturer; or

(vi) Damage or malfunction due to use of the device in a manner not in line with the manual.

 

7.3.4.4 Making a claim under the provisions regarding international support

 

(a) To receive service under the provisions regarding international support, you must:

(i) Make the claim to the Customer Service Center by calling +49 800 - 1114 767, or from abroad by calling the toll-free hotline +800 2559 2559, as soon as your device has suffered accidental damage or you become aware that you are entitled to claim statutory defect rights or make claims under the voluntary manufacturer warranty and provide the following information: (1) serial number of the corresponding device; (2) description of symptoms, problems with the device or reasons for damage to the device; (3) error messages; and (4) measures taken before the device began incurring problems and the steps you have taken to resolve the problem;

(b) Philip Morris will review whether you are entitled to a replacement device in accordance with these Terms and Conditions of Eligibility. If you are entitled to a replacement device, then it will be provided to you in one of the following ways, as chosen by Philip Morris: See Section 7.3.3.4 (c), i - ii)

 

(c) You must comply with all applicable import and export rules and regulations, and you will be liable for any customs duties, sales tax, and other applicable taxes and duties which may be associated with delivery.

 

7.3.5 Your obligations

 

You have the obligation:

 

(a) To not abuse IQOS Care Plus Services;

(b) To secure and protect your customer profile on IQOS.com;

(c) To comply with all applicable laws and regulations.

 

 

7.3.6 Miscellaneous

 

7.3.6.1 IQOS Care Plus Services are not an insurance policy.

 

7.3.6.2 IQOS Care Plus Services are currently being provided free of charge.

 

7.3.6.3 The details regarding how the personal data submitted by you is processed are described in our privacy policy, which is available at https://www.pmiprivacy.com/de/consumer

 

7.3.6.4 These Terms and Conditions of Eligibility and the contractual relationship with you will be governed by German law under exclusion of the UN Convention on Contracts for the International Sale of Goods.

8 Liability for damages

 

8.1 Philip Morris is liable for damages in accordance with statutory provisions unless otherwise stipulated below.

 

8.2 In the event of breaches of duty - irrespective of the legal ground - Philip Morris will be responsible for intent and gross negligence in the context of culpa in contrahendo liability. Subject to a milder standard of liability under statutory provisions (e.g. for diligence in one’s own affairs), Philip Morris will only be liable for ordinary negligence:

(i) for damages resulting from injury to life, limb, or health, and

(ii) for damages arising from a not inconsiderable breach of an essential contractual obligation (an obligation whose fulfillment is essential for due performance of the contract and the observance of which the contractual partner regularly relies on and may rely on); in this case, however, liability is limited to compensation for damage that is foreseeable and typical.

 

8.3 The above limitations of liability also apply to third parties and to breaches of duty by or on behalf of persons for whose fault Philip Morris is responsible for in accordance with statutory provisions. Claims under the German Product Liability Act will be exclusively subject to legal provisions.

 

9 Special provisions and rights of revocation for the option “IQOS trial month”

 

9.1 It is possible to order certain products in the IQOS Webshop for testing purposes. The trial period is 30 days from arrival of your order (“trial period”).

During the trial period, the products will be provided to you free of charge for use. During the trial period, you’ll be able to make full use of the products. If you do not return the products to Philip Morris within the trial period (as measured from the point in time of dispatch), then you will acquire the products at the purchase price named on the website.

 

9.2 If an option to order for testing purposes is available, then you will be notified on the website accordingly. Furthermore, the Webshop will show the purchase price to be paid after the trail period has expired. If you do not pay the purchase price on time after the trial period has expired and payment reminders remain unsuccessful, then we will transfer the payment claim to a collections company.

 

9.3 Orders for testing purposes are otherwise subject to these General Terms and Conditions with the following amendments and supplements:

 

(a) When placing an order for testing purposes, you are simultaneously submitting two binding offers to Philip Morris, specifically an offer to enter into a contract for free use limited to the trial period, and an offer to conclude a purchase contract. Your purchase offer is subject to the condition that you do not return the products to Philip Morris during the trial period.

 

(b) By clicking on the button [“Order now with payment obligation” / “Zahlungspflichtig bestellen”] in the IQOS Webshop, you are submitting the declarations (offers) named under (a). Philip Morris accepts both offers by sending the products. The purchase contract for the products will materialize at the end of the trial period and your chosen payment method will be charged unless you have returned the products to Philip Morris within the trial period.

 

 

 

(c) (Also) when placing an order for testing purposes, you will not acquire ownership of the products until the purchase price has been paid in full.

 

9.4 Consumers also have statutory rights to revocation when placing distance sale orders for testing purposes. Your rights to revocation are subject to Section 6 of these General Terms and Conditions; in particular, Sections 6.2 and 6.3 also apply to orders for testing purposes. However, the Revocation Instructions under Section 6.1 are replaced by the following:

10 Final provisions

 

10.1 These General Terms and Conditions and the contractual relationship with you will be governed by German law under exclusion of the UN Convention on Contracts for the International Sale of Goods.

 

10.2 Should any provision of these General Terms and Conditions be invalid, the validity of the remainder of the contract remains unaffected. The relevant legal provisions will apply in place of the invalid provision.

Before you place a binding order, you can add any products to your shopping cart without an obligation to buy. You can view the contents of the shopping cart at any time without obligation. You can remove the products placed in the shopping cart at any time. In order to buy products in the IQOS Webshop, you must have an IQOS customer account and be logged in with it. If you want to buy the products in the shopping cart, then click on the “Checkout” (“Weiter zur Kasse”) button. The next step will show you the personal information stored in your profile. Here, you’ll have the option of changing your delivery address for the order and you can select the payment method. If you then click the “Proceed to review” (“Weiter zur Überprüfung”) button, you will see an overview of your products added to the shopping cart and your chosen payment method. If you have chosen a credit card as the payment method, then you can complete the payment process after entering the required payment information directly in the IQOS Webshop by clicking on the button “submit order” (“Bestellung Aufgeben”) button. Should you choose PayPal, Sofortkauf, or Klarna as the payment method, then after clicking on the button “PayPal” for PayPal, “Continue to Online bank transfer” (“Weiter zu Online bank transfer.”) for Sofortkauf, or “Place your order” (“Bestellung aufgeben”) for Klarna, you will be redirected to the website of the respective service provider directly and complete the payment process on the corresponding service provider website.
