STARTER KIT OFFER TERMS AND CONDITIONS

I. GENERAL

1. The STARTER KIT Offer (“Offer”) is open to adult smokers 18 years old (as of the date of his/her participation in the Offer) and above residing in the Philippines who otherwise wish to continue to use tobacco or nicotine containing products, and only to IQOS and IQOS.com account owners who do not currently own a registered IQOS ILUMA Prime, IQOS ILUMA and IQOS ILUMA One, BONDS BY IQOS, or IQOS ORIGINALS One Device Kit (“Customers”).

2. IQOS Stores are operated by ActivAsia Inc. (or "AAI"). IQOS.com is owned by Philip Morris International and its affiliate in the Philippines, PMFTC Inc ("PMFTC"). The online store of IQOS.com is operated by AAI, and all orders are fulfilled by AAI, as an authorized distributor of PMFTC products sold in IQOS Stores, IQOS Coaches, and IQOS.com. Deliveries are carried out by AAI or by AAI’s authorized third-party delivery providers. This Offer is being carried out by AAI as an authorized distributor of PMFTC products.

3. The Offer period is from February 1, 2024 to December 31, 2024. PMFTC/AAI has the sole discretion to shorten or extend the Offer period if circumstances so warrant.

4. PMFTC/AAI reserves the right to modify, change, or revise the rules and mechanics of the Offer.

5. Customers who use multiple IQOS.com or IQOS accounts to participate in the Offer will be disqualified. PMFTC/AAI reserves the right to disqualify any Customer if there is any evidence of fraud or irregularities in his/her participation in the Offer.

6. PMFTC/AAI reserves the right to hold, suspend or block a Customer’s IQOS Club, IQOS.com and or IQOS account due to suspicious, fraudulent or illegal activity

7. PMFTC/AAI reserves the right to cancel, amend, or revoke this Offer without notice in the event of fraudulent activity, cheating, a security breach or any anticipated breach of any applicable law or regulation, an event or disturbance outside of PMFTC/AAI’s control such as acts of God, civil or military events, catastrophes, technical issues/connectivity, pandemic or war. Any changes to the Offer will be announced accordingly.

II. MECHANICS

1. The Offer is a one-time introductory offer for Customers who will buy an IQOS device for the first time (with the following Offer prices listed below) consisting of an IQOS ILUMA Prime, IQOS ILUMA and IQOS ILUMA One, BONDS BY IQOS, or IQOS ORIGINALS One Device Kit and free packs of heated tobacco sticks (compatible to the relevant IQOS device) (“Starter Kit”):

2. The Offer can only be availed in the following points-of-sale:
a. Official IQOS Stores
b. IQOS.com (online store)
c. IQOS Coaches
d. IQOS Field Sales Representatives
e. Participating Supermarkets, Convenience Stores and Specialty Stores: select branches of the listed retailer partners below, more particularly listed in Annex A.
i. Robinsons Supermarket Group (Robinsons Supermarket, Robinsons Easymart, Shopwise)
ii. 7-Eleven branches
iii. Lighters Galore
iv. DJ Shop
v. Green Puff
vi. Sondrik
vii. FUMA
viii. Planet Vape
f. Participating Retailers or IQOS/ Bonds Authorized Retailers:
i. Participating retailers are retailers who have been selected by PMFTC to be the “Participating Retailers” for this Offer. These retailers are retail (business-to-business) customers are enrolled in the Appwards Digital Trade Engagement (DTE) platform.
ii. IQOS/ Bonds Authorized Retailers are identified PMFTC Directly Serviced Points of Sale that can offer IQOS promotions to legal age consumers residing in the Philippines who otherwise wish to continue to use tobacco or nicotine containing products (“Customers”).

3. Customers must log in to their IQOS.com account to check if they are eligible for the Offer.IQOS Store Sales Experts, IQOS Coaches and IQOS Field Sales Representatives can also check the Customer’s profile to see if the Customer is eligible for the Offer

4. The Offer is only for Customers who are new or first time purchasers of IQOS devices and can only be combined with the “Employee Referral Program”, “Refer A Friend Program”, “Brgy. Intro Offer” – etc. However, the Offer cannot be combined with other promotions or programs such as the Trade-in Promotions, etc.

5. PMFTC and/or its authorized representative will verify the identity and age of each Customer. Customers who fail to pass the verification procedure (e.g. age non-eligibility) shall be informed that they are not eligible to avail of the Offer.

III. DELIVERY (for IQOS.com online store)

1. Customer will be subject to age verification process where he/she will be required to present a valid Government Issued ID before the Offer can be claimed.

2. To facilitate the purchase and delivery from IQOS.com, Customer must present any of the following valid Government Issued IDs as proof of age:Passport, Alien Certificate of Registration, Driver’s License, Firearms License, NBI Clearance Card, Philhealth ID, Postal ID, PRC ID, SSS ID, TIN ID, Unified Multi-Purpose ID or Voter’s ID.

3. In cases where Customer cannot accept the delivery, an authorized representative who is at least eighteen (18) years old and above can claim on behalf of the Customer provided the following documents are presented to the courier:
a. Valid government issued ID of representative for identity check and age verification
b. Copy of a valid government issued ID of Customer for identity check and age verification
c. Signed authorization letter stating that the Customer is authorizing the representative to receive the IQOS ILUMA Prime, IQOS ILUMA and IQOS ILUMA One, BONDS BY IQOS, or IQOS ORIGINALS One Device Kit and the Starter Kit choice of TEREA™, BLENDS, or HEETS™ packs and order reference number.

4. The courier will not be able to deliver the Customer’s IQOS ILUMA Prime, IQOS ILUMA and IQOS ILUMA One, BONDS BY IQOS, or IQOS ORIGINALS One Device Kit Device Kit and respective Starter Kits if any of the above-required documents are not presented.

5. For deliveries, the courier will communicate and coordinate details, with delivery attempt at a maximum of two (2) times.A third delivery attempt will be available in selected cities that offer same/next day delivery; and can be arranged with an additional delivery fee that will be communicated in advance by AAI/courier, and to be confirmed by the Customer In the event of failure to receive the delivery for credit card or GCash transactions, normal refund process will be followed:
a. For credit card transactions:
i. For Credit Cards issued locally: Refund will take up to 10 working days but also subject to issuing bank lead times
ii. For Credit Cards issued abroad: Refund will take up to 45 days, but also subject to issuing bank lead time
iii. You may check the status of your refund with your issuing bank.
b. For GCash transactions, refund must be coursed through IQOS Customer Care team. The Customer shall call IQOS Customer Care team to trigger the refund process and will be able to credit back to the Customer’s GCash account real time.

6. In instances of non-eligibility of the Customer to avail of the Offer, Customers who opted to pay in credit or through GCash will follow standard refund process as stated in Section III.5.a – b.

IV. STARTER KIT REDEMPTION IN PARTICIPATING RETAILERS/SARI-SARI STORES

1. IQOS Activation Booths are booths situated at Participating Retailers manned by IQOS Field Sales Representatives. Customers may avail of the IQOS ILUMA One, BONDS BY IQOS, or IQOS ORIGINALS One (if available) Device Kit and the Starter Kit choice of TEREA™, BLENDS, or HEETS™ packs in these IQOS Activation Booths.

2. The IQOS Starter Kit Voucher is a unique voucher code sent via SMS on which the Customer can use to avail of the Offer at Participating Retailers after purchasing an IQOS ILUMA One, BONDS BY IQOS, or IQOS ORIGINALS One (if available) Device Kit for the first time. Customers will receive an SMS within 1 day from purchase of the relevant IQOS device kit indicating the IQOS Starter Kit Voucher for the free packs of heated tobacco sticks that the Customer is eligible to receive. The IQOS Starter Kit Voucher is only redeemable at Participating Retailers/Sari-Sari Stores.

3. The IQOS Starter Kit Voucher can only be used in full in a single transaction and is not transferable nor convertible to cash. Any amount not used cannot be exchanged for cash or another IQOS voucher and will be automatically forfeited.

4. The IQOS Starter Kit Voucher can be redeemed within 3 calendar days upon receipt of the voucher by the Customer.

5. PMFTC/AAI shall not be liable for any failure of a Customers to redeem or use any IQOS Starter Kit Voucher, and will not refund such voucher due to among others, loss, negligence or mishandling on the part of the Customers.

6. In case the Customer does not receive the IQOS Starter Kit Voucher within 1 day from purchase of the relevant IQOS device kit, Customer may request for an IQOS Starter Kit Voucher from IQOS Customer Care, subject to the following:
a. Review of instance/scenario of the alleged non-receipt of the IQOS Starter Kit Voucher
b. No evidence of any suspicious, fraudulent, or illegal activity or no breach of any of the requirements for eligibility for the Offer as provided in these terms and conditions of the Offer

7. If Customer is still eligible to use the IQOS Starter Kit Voucher, IQOS Customer Care will send the replacement IQOS Starter Kit Voucher to the Customer’s nominated email address/mobile number as reflected in IQOS.com. It is the responsibility of the Customer to update his/her personal details in the IQOS.com account to ensure timely receipt of the replacement IQOS Starter Kit Voucher. PMFTC or AAI shall not be liable for any failure of a Customer to redeem or use the IQOS Starter Kit Voucher and will not provide any refund for the IQOS Starter Kit Voucher due to non-receipt by the Customer of the replacement IQOS Starter Kit Voucher due to incorrect/wrong contact details that the Customer provided either in IQOS.com or to the IQOS coaches or IQOS Field Sales Representative when registering their IQOS account.

8. Issuance of the IQOS Starter Kit Voucher is subject to possible delays due to operational, technical and system limitations. Customers will be advised beforehand if such is the case.

9. PMFTC reserves the right to change the value of the IQOS Starter Kit Voucher if circumstances warrant.

V. OTHERS

1. All decisions of PMFTC and/or AAI and its authorized agents in all matters relating to the interpretation and implementation of these mechanics/terms and conditions of the Offer are final, and no objections and/or appeals thereon will be entertained.

2. Customers in the Offer agree and confirm the following:
a. that you are a legal-age smoker, 18 years old or above residing in the Philippines as of the date of his/her participation in the Offer;
b. that you have read and understood the terms and conditions detailed herein;
c. that you agree to follow the applicable mechanics of the Offer;
d. that you agree to assume all such risks, foreseeable or otherwise, and hereby release and discharge PMFTC and/or AAI, its affiliates and all other persons and entities connected with the Offer from any liability for, or any claims that may arise in respect of, any and all property losses and/or injuries whatsoever that you may sustain, no matter how any such property losses and/or injuries are caused.

4. Devices bought by Customers using IQOS Store vouchers/other vouchers, special offers or through promotional activities are non-refundable.

5. PMFTC will not be liable to the Customers for any taxes, costs, liabilities or expenses that may arise from this Offer.
